Refunds and disputes

Version 6 · Published: 2026-10-07

1. Scope

This policy applies to any real estate broker, agency or team ("you", the "Customer") that subscribes to Mia, regardless of the plan selected (Départ, Pro, Équipe, with or without GED). It forms part of the Mia terms of use. Mia is a service intended for professionals and used for business purposes.

2. Subscription, billing and renewal

2.1 Subscriptions are monthly, payable in advance, in Canadian dollars, plus applicable taxes (GST and QST).

2.2 Your subscription renews automatically each month at the rate of your selected plan until cancelled.

2.3 By subscribing, you authorize Mia to charge the amount due each month to the payment method you provided. You agree to keep that payment method valid.

3. Cancellation

3.1 You may cancel your subscription at any time by writing to support@bonjourmia.com.

3.2 Cancellation takes effect at the end of the monthly period already paid. You keep access to Mia until that date. No further charges are made after cancellation.

3.3 To avoid being charged for the next period, your cancellation must be received at least 2 days before the renewal date.

4. No refunds

4.1 All payments are non-refundable. This includes, without limitation: partially used or started months, mid-month cancellation, non-use of the service, a downgrade, the Customer ceasing activity or losing their licence.

4.2 No refund or credit is granted because fewer transactions were processed than the Customer anticipated.

4.3 Mia may, at its sole discretion and without obligation, grant a commercial credit in a particular case. Doing so creates no precedent or right for the future.

5. Launch offer and price changes

5.1 Any promotional rate (e.g., the launch offer) applies for the period stated in the offer, with no retroactive refund on cancellation, and ends automatically when that period expires, after which the regular rate applies.

5.2 Mia may change its prices with at least 30 days' written notice. If you do not accept the new rate, you may cancel before it takes effect in accordance with section 3.

6. Customer validation and liability

6.1 Mia automates administrative tasks (document retrieval, creation of transactions, contacts, brokerage contracts and seller declarations, Centris data entry, deposit into the GED). Mia is an assistance tool and does not replace the broker's professional judgment.

6.2 The Customer is solely responsible for verifying and validating all information, documents and data entered, generated, retrieved or deposited by Mia before using, publishing or sending them to any third party, including on Centris and in the GED. The Customer remains solely responsible for complying with its legal and professional obligations toward its own clients and regulators.

6.3 Mia has no obligation to correct, redo or complete any entry or document, or to refund or credit any amount because of an error, omission or delay. Mia may, at its sole discretion, fix an anomaly or re-run a task, without this creating an obligation or an admission of liability.

6.4 To the extent permitted by law, Mia is not liable for direct or indirect damages (loss of a sale, commission or clients, reputational harm, disciplinary action, etc.) arising from an error or omission in information processed by Mia, nor for the unavailability or change of third-party systems (Centris, public registries, municipalities, school boards, the GED).

6.5 Nothing in this policy excludes or limits a liability that cannot be excluded or limited by law, including in cases of intentional fault or gross fault, or bodily or moral injury.

6.bis Third-party availability

Mia relies on third-party services outside its control. Their interruption or modification does not entitle you to a refund.

7. Invoice disputes and chargebacks

7.1 If you believe an invoice is incorrect (e.g., double charge, rate inconsistent with the accepted offer), write to us at support@bonjourmia.com within 30 days of the charge, stating the date, amount and reason.

7.2 We review your request and respond within a reasonable time, normally 10 business days. A confirmed billing error is corrected by a refund or credit of the amount wrongly charged.

7.3 Before disputing a charge with your financial institution or card issuer (chargeback), you agree to follow the procedure in section 7.1. A chargeback filed without this step, or for an amount that is owed, may result in immediate suspension of your access to Mia, and we may claim the unpaid amounts and the chargeback fees we incur.

8. Dispute resolution

8.1 Written notice. A party wishing to raise a dispute relating to Mia or this policy must notify the other party in writing, describing the facts and the remedy sought. Notice to Mia is sent to support@bonjourmia.com with a copy to 353 rue Blanchard, Rosemère, Quebec J7A 1Y7.

8.2 Good-faith negotiation. The parties will negotiate in good faith for at least 30 days after receipt of the notice to try to resolve the dispute amicably. Communications during this period are confidential and may not be used as evidence.

8.3 Quebec courts. Failing agreement within that period, the dispute will be submitted exclusively to the competent courts of Quebec, in the judicial district of Terrebonne. The parties expressly consent to this.

8.4 Governing law. This policy is governed by the laws of Quebec and the federal laws of Canada applicable therein, excluding any conflict-of-laws principles.

8.5 Sections 8.1 and 8.2 do not prevent a party from seeking urgent or protective relief, or from interrupting a limitation period.

9. Changes

We may amend this policy with at least 30 days' notice, posted on our website or sent by email. Continued use of Mia after the change takes effect constitutes acceptance. Changes do not apply to periods already paid.

10. Language

The parties have required that this policy be drawn up in French and English. In case of interpretive discrepancy, the French version prevails.
